VIP Fit Club Membership Agreement

1.  The undersigned ("Member"), desires to become a member of VIP Fit Club and agrees to the following terms and conditions:

3. Membership Structure: All memberships at VIP Fit Club are structured as month-to-month, Term or session packages (when paid in full). Payments for these memberships are due in advance.

 4. Payment Authorization: Automatic payment drafts for membership fees will continue unless a written notice of cancellation is provided at least thirty (30) days prior to the intended cancellation date. Such notice must be delivered via certified mail, hand-delivered to the management of VIP Fit Club, or sent electronically to info@vipfitclub.com .

5. Mobile Access/Key Fob Return: If the member has been issued a 24/7 key fob for facility access, it is the member's responsibility to return the key fob to VIP Fit Club management in order to halt any ongoing electronic funds transfer (EFT) related to the membership. Failure to return the key fob will result in continued charges until the key fob is returned. Mobile access will be deacativated upon cancalation or nonpayment.

 6. No Refund Policy: All payments made to VIP Fit Club are non-refundable. This includes any fees associated with membership, key fob issuance, or service fees.

7. Key Fob Service Fee: Members opting for the key fob access agree to pay a one-time service fee of $10, in addition to the current monthly membership fees, which will be automatically withdrawn from the member's designated financial institution account as per the debit authorization form signed by the member.

8. Promotions and Renewals: Any sales promotions, holiday coupon discounts, or other discounts will apply only for the duration of the membership purchased. Upon expiration of the membership term, the member may renew their membership at the standard rates as listed by VIP Fit Club.

9. DEFAULT/REMEDIES. Any monthly payment received more than ten (10) days after the due date shall be subject to a late charge of ten percent (10%) of the amount due or Twenty Dollars ($20.00), whichever is greater.

10. RELEASES AND WAIVER OF LIABILITY. Member recognizes that there are hazards and risks connected with physical fitness training. These risks include but are not limited to, abnormal blood pressure, fainting, heart disorders and heart attack, dehydration, heat exhaustion, sprains, muscle strain, blisters, stress fracture, shin splints, tendonitis, cartilage tears, bursitis, back pain and bruising of joints. Exercise beyond one's physical limits and/or accidents involving exercise equipment may result in serious injury or even death.

Member agrees to defend, indemnify, and hold harmless VIP Fit Club & Amor Enterprises, LLC any loss, damage or expense incurred by reason of any claim or liability based upon personal injury (including death) or property Damage arising out of the negligent or intentional action of Member. Member further agrees to release VIP Fit Club & Amor Enterprises, LLC, and its owners, officers, agents, employees, and/or affiliates from any and all liability arising out of injury to Member, and further agrees to defend, indemnify, and hold VIP Fit Club its owners, officers, employees and/or affiliates free and harmless from against the same.

11. RULES AND REGULATIONS. Member acknowledges that VIP Fit Club (& Amor Enterprises, LLC) operates under rules and a regulation established for the safety and protection of its members and agrees to be bound by such rules and regulations, as well by the rules and regulations subsequently approved and posted or otherwise published by VIP Fit Club. Such rules and regulations in effect from time to time are incorporated into this Agreement by reference. Facilities, equipment, hours, service, regulations and policies are subject to change from time to time, without prior notice, in the sole discretion of VIP Fit Club and its affiliates. Member agrees to accept such reasonable change(s) as a condition of membership. Member additionally recognizes:

a. Under no circumstances shall Member move exercise equipment or use the equipment in any

manner not authorized by VIP Fit Club.

b. Member will not misuse the equipment.

c. All members must be at least eighteen (18) years of age.

d. VIP Fit Club shall not be responsible for any lost or stolen items

e. No Member shall allow entry of any unauthorized persons under any circumstance

11. PROHIBITED ACTIVITIES.  
Facility Rules and Guidelines

Outdoor shoes are not permitted inside the facility.

The use of alcohol, drugs, and smoking/vaping is strictly prohibited both inside and outside the facility premises.

Members must not use the facility or engage in any activities at VIP Fit Club while under the influence of drugs, alcohol, or any medication that may impair their ability to safely operate equipment.

Headphones or earbuds must be used when listening to personal music.

Only VIP Fit Club staff are authorized to provide personal coaching or fitness training within the facility.

Solicitation or promotional activities by anyone other than VIP Fit Club staff are not allowed.

Fitness coaching, social media photos, or training on the premises are only permitted when conducted by VIP Fit Club staff.

12. DRESS POLICY. VIP Fit Club requires that members wear appropriate clothing and footwear while in the Facility. No outdoor shoes can be worn in the facility. Street shoes and black-soled shoes are prohibited within the Facility. Bring a separate clean pair of shoes to change into.  Appropriate clothing includes gym shorts, T-shirts, jogging suits, aerobic wear, and sweat outfits. Street clothing and jeans are not considered appropriate clothing.

13. MEMBERSHIP- VIP 24/7 Access Membership Terms & Conditions

As a member of VIP Fit Club, you are granted 24/7 access to our private training facility under the following terms:

🔒 Facility Access & Conduct

Members are responsible for scanning in with their assigned digital access key or app upon every visit.

Sharing access with non-members is strictly prohibited and may result in immediate termination of membership.

Members must follow all posted guidelines regarding equipment use, cleaning protocols, and respectful conduct toward other members and staff.

⚠️ Safety & Facility Use

For your safety and the integrity of our community, members must not engage in reckless, unsafe, or unsanctioned activities within the facility.

Members agree to use equipment properly and report any malfunctions or safety concerns immediately.

🚫 Violation Policy

VIP Fit Club reserves the right to revoke 24-hour access privileges or terminate membership without refund for any of the following:

Violation of gym rules or policies

Disrespectful, unsafe, or aggressive behavior

Unauthorized access of self or others

Misuse or damage to equipment or facilities

📄 Acknowledgment

By enrolling in the VIP 24/7 Access Membership, you acknowledge that you have read, understand, and agree to comply with all VIP Fit Club rules, safety protocols, and terms of use. Your continued access is contingent upon maintaining these standards.

14. SUSPENSION AND TERMINATION. I understand that VIP Fit Club may suspend or terminate my membership at any time, in its sole and absolute discretion, for non-payment of Membership Fees or for violation of any of VIP Fit Club policies and procedures, and that in so doing, VIP Fit Club assume no further liability to adhere to the terms of this Agreement. 

15. ACCEPTANCE OF TERMS. As a Member, I understand that I am entitled to use the Facility

within the scope of the membership that I have selected, and that I am obligated to pay my dues and fees regardless of whether or not I use the Facility. I agree to promptly update VIP Fit Club any change in my contact information (including address, telephone number or email address, and updated photo) or change in credit information.

I certify that I have read the foregoing Membership Agreement and that by signing below, I acknowledge that I understand and agree to be bound by all of the terms and conditions hereof. I further acknowledge that a fully executed copy of this Membership Agreement has been provided to me. By signing this agreement, the member acknowledges and agrees to the terms outlined above.

By signing electronically, you agree that your electronic signature has the same legal force and effect as a handwritten signature. This acknowledgment applies to all membership agreements, waivers, and policy acceptance forms executed through VIP Fit Club’s digital platforms.
