⚖️ TERMS AND CONDITIONS
1. Member Acknowledgments & Health Disclosures
The Member affirms that the information provided in the Health Questionnaire is accurate and complete. Member certifies they are physically able to participate in fitness activities and have no condition that would prevent safe use of VIP Fit Club facilities. Member assumes all responsibility for their health and safety and acknowledges that VIP Fit Club has not made any medical evaluations.
2. Membership Fees & Billing Options
All membership dues are non-refundable and must be paid in full or via monthly draft.

If selecting monthly draft, Member authorizes recurring billing from their preferred payment method. Member agrees to keep payment information current and acknowledges a failed payment may result in suspension of access.
3. Term & Cancellation
All memberships renew automatically unless canceled with 30 days' written notice via certified mail, email to management, or the official cancellation form inside the Member Portal. No mid-month prorations or partial refunds will be issued.
4. Right of Rescission
You may cancel this agreement within 3 days of signing for any reason and receive a full refund. Cancellation must be submitted in writing.
Cancellations due to medical restrictions within the first 30 days must include a written physician’s statement explicitly prohibiting physical activity. Refunds (if applicable) will be issued within 15 business days.
In the event of death, the Member’s estate shall be released from future obligations but not entitled to any refund of prepaid dues.
5. Late Fees & Default
Payments made more than 10 days late incur a $20 or 10% late fee, whichever is greater. After 20 days delinquency, the account is considered in default. VIP Fit Club may suspend or terminate membership, with the balance still due. Member agrees to cover reasonable collection costs and legal fees incurred.
6. Release of Liability & Indemnification
By signing, Member acknowledges the risks of physical activity, including injury, illness, or death, and assumes full responsibility for participation.
VIP Fit Club, its owners, affiliates, and agents are released of all liability for any injury, loss, or damage suffered by Member. Member agrees to indemnify and hold harmless VIP Fit Club from any claim arising from misuse of the facility, violation of policies, or negligent behavior.
7. Facility Rules & Conduct
Members agree to abide by all posted and published rules. VIP Fit Club reserves the right to update policies as needed.
Key rules include:
Equipment must be used properly and not moved.
Members must treat staff, guests, and equipment respectfully.
Member must be 18+ unless otherwise approved by management.
VIP Fit Club is not liable for lost or stolen property.
Clean indoor shoes required — no outdoor footwear on gym floor.
8. Prohibited Behavior
Prohibited on the premises:
Smoking, alcohol, recreational drugs, or performance-enhancing substances.
Possession of weapons.
Playing audio through speakers (headphones only).
Disorderly conduct, vandalism, or harassment.
9. Dress Code
Proper gym attire is required:
T-shirts or tanks, shorts, leggings, and athletic footwear.
No jeans, open-toed shoes, or sandals.
No dirty or outdoor shoes allowed — bring clean indoor sneakers.
10. Membership Types
Standard 24/7 Access
Couple & Family Plans (Subject to photo ID verification for each)
Online Coaching / Virtual Programs

11. Suspension & Termination
VIP Fit Club may suspend or terminate membership without refund for:
Non-payment
Policy violations
Disruptive behavior
Safety hazards posed by the Member
12. Independent Services
VIP Fit Club is not responsible for services offered by independent contractors (e.g., personal trainers, therapists) on premises. Members engage with them at their own risk.
13. Modifications & Rights Reserved
VIP Fit Club reserves the right to:
Adjust facility hours
Modify pricing or programs
Add, change, or discontinue equipment or services
Enforce facility closures for maintenance or emergencies
14. Member Portal & Digital Onboarding Requirement
Before receiving gym access, the Member must:
Submit contact info, photo ID, and payment
Sign this Agreement digitally
Upload a personal headshot photo
Complete onboarding videos in the VIP Fit Club Member Portal
Access is issued only when these steps are verified.
15. Legal Jurisdiction & Severability
This agreement shall be governed by the laws of the State of New York. Any disputes shall be venued in Wayne County, NY. If any portion of this agreement is deemed unenforceable, all remaining clauses remain in effect.
